SUMMARY:NYS Council Antitrust Training
DESCRIPTION:The NYS Council wants our members to have a clear understanding of the rules of the road related to sharing information about rates and other provisions in their contracts with commercial insurers. To this end\, we will host an important one-hour training next Friday\, October 28\, from 9:00-10:00 sharp.  Please save the date!   \nMore about the Training: \nCommercial Contracts and Antitrust: Why it is Never a Good Idea to Share Reimbursement Rates with Other Providers \nHealth plans generally regard reimbursement rates as confidential and proprietary information.  As a result\, disclosure of negotiated rates to other agencies can result in breach of confidentiality obligations under an agency’s commercial contracts\, potentially triggering financial penalties and terminations.  More problematic\, discussion of negotiated rates with other agencies can be viewed as unlawful price-fixing activities under federal antitrust law.  This webinar will offer recommendations to comply with commercial contracts and federal antitrust laws and explain the limited circumstances in which agencies may share payment rates with third parties without running afoul of legal obligations. \nThe speaker for this webinar\, Adam Falcone\, is a partner at Feldesman Tucker Leifer Fidell LLP.  Prior to joining the law firm\, Adam served as Trial Attorney in the Antitrust Division of the U.S. Department of Justice\, where he was assigned to the Health Care Task Force. \nNote:  This is the first in a series of NYS Council hosted trainings designed to address various aspects of contracting with insurers.  Stand by for further information about additional offerings. \n

SUMMARY:Office of Attorney General WNY Mental Health Hearing
DESCRIPTION:The Office of the Attorney General is pleased to announce a public hearing on access to mental health care for people with serious mental illness in Western New York. The Attorney General’s first public hearing on mental health in June 2022 in New York City elicited a wide range of testimony\, much of which was specific to the downstate region. In this second hearing\, the Attorney General seeks testimony on the challenges to accessing adequate mental health treatment in Western New York\, including crisis services for children and adults\, and the interface between the health care and criminal justice systems. \nOn Wednesday January 18th at 11AM\, Attorney General James will hold an in-person hearing at the Buffalo & Erie County Public Library\, in the Mason O. Damon Auditorium at 1 Lafayette Square Buffalo\, NY 14203.* Members of the public are invited to provide written or oral testimony relevant to this hearing. Please note that this is a regionally focused hearing and testimony will be limited to discussion of access to mental health care in Western New York. \nOral testimony for the hearing will be subject to scheduling constraints. Individuals who wish to provide oral testimony at the hearing must submit their request to testify\, including a brief summary of the testimony they plan to provide\, by the close of business on Wednesday\, January 11th at the following web address: http://ag.ny.gov/mental-health-hearing. Written testimony submissions will be accepted through January 18th. \nMembers of the public are welcome to attend the hearing in-person. SUMMARY:OMH Assisted Outpatient Treatment Focus Group
DESCRIPTION:The New York State Office of Mental Health (OMH) is in the process of evaluating Assisted Outpatient Treatment or AOT  – also known as Kendra’s Law – and planning for a new study to evaluate the AOT program.   We have set up a focus group for the public mental health system – providers – with experience serving individuals enrolled in AOT. \nThe purpose of this focus group is to help us obtain input from you\, as a provider of service to individuals on AOT\, about what’s most important to study.  We’re also seeking input from individuals with lived experience related to AOT\, their family members and the advocacy community.  For information about those focus groups\, please email Suzanne Feeney\, Suzanne.Feeney2@omh.ny.gov \nFocus Group Information: February\, 2nd\, 2023   10:00am-11:30am \n Registration Link: \nhttps://meetny.webex.com/weblink/register/rebeb923e6b4a6703c9f59352e4f4a75a \nHistory \nOn August 9\, 1999\, the Governor signed Kendra’s Law (Chapter 408 of the Laws of 1999)\, creating a statutory framework for court-ordered Assisted Outpatient Treatment (AOT) to ensure that individuals with mental illness and a history of hospitalizations or violence participate in community-based services appropriate to their needs. The law became effective in November of 1999 and reviewed periodically by the legislature for continuation.  Since that time\, the New York State Office of Mental Health (OMH) has been evaluating the impact of Kendra’s Law on individuals receiving court-ordered services. This past Budget session\, in April of 2022\, included several new substantive changes\, and again extends the law until 2027. In 2009 the Duke Study was published\, which was the first independent evaluation of the program. \nFor more information about AOT please visit: https://my.omh.ny.gov/bi/aot \nAgain\, we’re inviting your participation in the focus groups to help us plan for an updated\, objective study of the AOT program.  Thank you!  \nQuestions about the focus groups can be sent to Suzanne Feeney\, Suzanne.Feeney2@omh.ny.gov

SUMMARY:OMH Community Engagement Feedback Sessions
DESCRIPTION:Governor Hochul’s 2023 State of the State plan and Fiscal Year 2024 Executive Budget include historic proposals and resources that will allow the Office of Mental Health (OMH) to expand\, strengthen\, and revitalize the State’s mental healthcare system. Your input will be integral in OMH’s planning process for this expansion. \nIn the months ahead\, we will be developing new programs and policies that will greatly expand access to housing\, outpatient\, school-based clinics\, and hospital services\, and increase insurance coverage for mental health services. \nTo ensure we make the most of this unprecedented opportunity\, OMH is seeking input from valued partners\, providers\, advocates\, people and families that receive services\, community leaders\, and community members. We encourage service providers to share this announcement with the people and families they serve and assist with registration if needed. \nWe will be hosting a series of virtual and in-person community engagement feedback sessions to gain insight from your experiences and knowledge. Your feedback will help us determine how to best implement new programming and use new resources to enhance the mental health system\, increase access to mental health services\, and eliminate service gaps and promote equity in access for all New Yorkers\, while fortifying the continuum of care. \nOMH leadership will provide an overview of the planning initiatives and then we will break into groups for focused discussion.
Today we are announcing four virtual sessions and the in-person sessions across the state will be announced soon.
