Last year, the NYS Council and other access-focused advocacy organizations secured a commitment from state government to update New York’s Network Adequacy and related Access Standards for MH and SUD services.
Today the Department of Financial Services (DFS), the state agency with broad authority to regulate insurance in NYS that also has direct oversight responsibilities for commercial insurance, published a revised Rulemaking in the State Register. As you may recall, the NYS Council submitted two sets of comments at each opportunity for us to share our thoughts and concerns with the Department of Financial Services AND the NYS Department of Health.
Note: The last two pages of the Rulemaking (attached) describes the range of comments received and notes that DFS considered all the comments received and made changes to the regulation in response thereto.
