Today the following legislation was sent to the Governor for final action having recently passed in both houses of the Legislature. This one is moving fast. Hopefully that’s a good sign since this is the bill we’ve been tracking and pushing that would extend the time that certain practitioners have within which to obtain the Diagnostic Privilege, from June 2025 to June 2027. As such, these practitioners would be able to continue to engage in diagnosis and development of assessment-based treatment plans under the appropriate supervision and following all other relevant laws and regulations until 6/2027.
In the a.m. I will send a letter to the Governor’s Office on behalf of all of our members expressing vigorous support for immediate enactment of this important legislation. Stand by for more advocacy actions to support this critical bill.

AN ACT to amend chapter 230 of the laws of 2022, amending the education
law relating to diagnostic privilege, in relation to extending the
effectiveness of certain provisions thereof
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 6 of chapter 230 of the laws of 2022, amending the
education law relating to diagnostic privilege, is amended to read as
follows:
§ 6. This act shall take effect June 24, 2022; provided however, that
sections two and three of this act shall take effect June 24, 2024;
provided, further, that the provisions of section five of this act shall
expire and be deemed repealed June 24, [2025] 2027. Effective imme-
diately, the addition, amendment and/or repeal of any rule or regulation
necessary for the implementation of this act on its effective date are
authorized to be made and completed on or before such effective date.
§ 2. This act shall take effect immediately.
