The NYS Council  has been advocating for several months with the O agencies seeking assistance for our CCBHC Demo member agencies who are having issues with their secondary billing.  It is our understanding that the state will be issuing formal guidance shortly that will allow CCBHC Demos to submit secondary claims only without the T1040 on a temporary basis.  Until you receive the official guidance OMH has stated that you can submit this way so you can be paid properly. Demo agency providers are encouraged to continue to submit Medicaid only claims with the T1040 code, since these are paying properly. The guidance will be coming shortly.  I assume it will be coming from DoH, OMH and OASAS.
