Kaiser Family Foundation Issue Brief: The Case Challenging the ACA

Today marks Day 1 and opening remarks from both sides in the matter of what could arguably be the most significant challenge to date regarding the constitutionality of several  components of the ACA.  The case is being heard by the Supreme Court.

Two of the most significant issues in the balance are continued protections for those with pre-existing conditions, and the continuation of the requirement that states must offer benefits in 10 ‘essential’ areas (including mental health and substance use disorder) of healthcare for any policy offered through the state Health Insurance Exchange, or adjacent to it.
