The enacted state budget includes a new provision requiring notice to the Department of Health of certain “material” health care transactions. According to Brett Friedman, one of the authors of the Ropes & Gray Alert (linked below) and former NYS Medicaid Director, the new law will become an important consideration for entities engaging in many transactions that were previously not subject to state oversight, whether under certificate of need rules or state insurance regulation.
