Subject: Rescinding and reversing the termination letter from OASAS dated March 31st (emailed March 28th)

Dear Provider,

We are writing to notify you that we are rescinding and reversing the termination letter from OASAS dated March 31, 2025, pertaining to terminated Federal funding.  As you know, our NYS Attorney General and a coalition of 22 other states and the District of Columbia filed a lawsuit April 1, 2025, seeking an Emergency Temporary Restraining Order (TRO) and a Temporary Injunction to prevent the Federal government from terminating funding provided through the Coronavirus Response and Relief Supplemental Appropriations Act (CRRSA) and American Rescue Plan Act (ARPA) effective March 24, 2025. 

These terminations affected funding OASAS provides to your organization via Supplemental Substance Use Prevention Treatment and Recovery Block Grants (Supplemental SUPTRS) grants. 

The TRO was issued on April 5, 2025, directing the federal government to immediately halt enforcement of the funding terminations and to resume processing payments as if the termination notices had not been issued. The Court’s order restores the status quo while the case proceeds and ensures that funds will continue to be made available to grantees at this time. The Court has scheduled a hearing on the request for a preliminary injunction, which we expect to occur in mid-to-late April. The TRO will remain in effect until the Court issues a decision on that motion. The continued availability of funds may change based on the final outcome of the litigation. 

As a result of legal action taken by the NYS Attorney General, effective immediately, we will resume the reimbursement process for allowable expenses paid to date, per your executed contract(s).  At this time, OASAS expects to be able to reimburse for allowable expenditures paid between March 25, 2025, through the end date provided under the original contract date, pending the outcome of the current litigation to restore access to this federal funding.

If you do not wish to continue providing services consistent with your original contract, please email OASAS.sm.grants@oasas.ny.gov by end of day April 18, 2025 to notify OASAS that you DO NOT intend to resume submitting vouchers for these funds.

If you do intend to resume use of this funding, please continue to submit vouchers in the usual manner, including for services provided after March 24, 2025.

Requirements for Expense Reports:

•              Final Expense Reports are currently not due, unless you have fully expended the Budgeted value of your contract.

•              If you have submitted an Expense Report(s) for expenses paid through 3/28/2025 and have additional expenses paid after this date, please submit an Expense Report(s) for expenses paid 3/29/2025 and beyond.

•              If you have not yet submitted an Expense Report(s) for paid expenses through 3/28/2025, please submit an Expense Report to encompass the full month of March 2025.

All Expense Reports along with all required backup documentation should be submitted to the COVIDFundsVOUCHERS@oasas.ny.gov mailbox. For any questions related to Expense reports, you may reach out to OASAS Accounts Payable at COVIDFundsAP@oasas.ny.gov.
