HHS Pauses Enforcement of New PRWORA Interpretation

Court Stipulation Stays Enforcement for All Agencies In Plaintiff States

HHS has “agreed to stay enforcement and application through September 10, 2025” of its PRWORA notice nationwide. HHS further stated, “This period will permit [HHS] to consider, as appropriate, whether to provide additional information about the HHS PRWORA Notice.”

Also, on August 12, 2025, in State of New York, et al., v. USDOJ, et al., the court entered an updated “Stipulation and Joint Proposal for Briefing Schedule,” under which the Government agreed to pause enforcement and application of its new interpretation of “Federal public benefit” in Title IV of PRWORA in the Plaintiff States through September 10, 2025.
