PRWORA Litigation Update

In our continuing efforts to keep you up to date regarding recent changes and challenges to the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) we wanted to share the following update from our consultants at Feldesman, LLP.  Earlier this year the NYS Council hosted a series of training for our members, facilitated by immigration experts at Feldesman at a point where the confusion was high and the information was as clear as mud.  I think the Update below will help but if you need a refresher, just ask!  You can also look back at prior updates from Feldesman on this and related topics on this page:  https://www.feldesman.com/category/client-alerts/   Just search the acronym PRWORA or scroll down to updates in September, August and so on.  Most of the heavy action (to date) on this issue occurred over the summer.

Government Files Appeals in PRWORA Reinterpretation Cases
The federal government filed notices of appeal in two separate lawsuits challenging its reinterpretation of what constitutes a “Federal public benefit” under the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA).

The current injunctions remain in effect until the appellate courts rule.
