Here is the content of slide #22 from the slide deck OMH/OASAS and SED used during Thursday’s Scope of Practice Webinar.   

A qualified supervisor can supervise up to 5 Limited Permit practitioners.  This slide identifies which practitioner types count as Limited Permit practitioners for purposes of complying with the ‘5 supervisees with Limited Permits’ limit.

When the slide deck from yesterday’s OMH/OASAS/SED Scope of Practice Webinar – Diagnostic Privilege comes out I will send it to everyone immediately.  I’m writing because I am told that slide #22 of the deck contains further clarification re: the total number of Limited Permit staff an eligible supervisor can supervise.  To be specific, apparently the rule re: the number of Limited Permit staff that a qualified supervisor can oversee includes LMHCs seeking the Diagnostic Privilege (after June 2025 when they need it) as well as other Limited Permit holders.  Again, slide 22 speaks to this and I am waiting on the deck.

Yesterday the NYS Council met with leadership at the State Education Department and the Office of the Professions for one hour during which time we raised and illustrated the most critical barriers that currently or will soon impact access to care and continuity of care for the individuals we serve in OMH and OASAS settings as the result of recent scope of practice and other licensing changes.  

Many thanks to our provider members from Helio Health and Gateway-Longview for joining us for what was a very productive and enlightening meeting in which it was clear to us that those representing the state now have a very clear understanding of the impact of various changes in the law and the regulations related to scope of practice on our ability to serve New Yorkers in need of our services.   We received a commitment from our state colleagues to continue to dialogue with us regarding potential solutions and recommendations we have that may remedy or at least mitigate the problems we face that include: 
1) State application turnaround time lags are significantly impacting the ability of our members to hire and retain valued staff who can practice at the top of their scope but who are waiting for Limited Permits, licenses and the Diagnostic Privilege.  2) The grandfathering provision set to end on June 24, 2025 and the likely chaos that will ensue if there are still significant lags in processing applications at SED and OP.  3) Problems related to a lack of timely feedback from SED and OP when there is a problem / a document is missing, etc. with the submitted application. 4) Problems getting timely changes processed with SED/OP re: the names of the individuals being supervised by an eligible supervisor. 5) Problems obtaining transcripts and other required documents to make an application to State Ed. 

Important information coming from the Webinar:

Important Clarification: OMH and OASAS clarified today that it is not (as previously stated on an earlier webinar) that the qualified supervisor can only supervise 5 staff in total.  Instead the supervisor can only supervise up to 5 LIMITED PERMIT staff of any type but this does not mean the supervisor cannot supervise additional staff.
