A NYS Council high priority bill we highlighted earlier this week that was scheduled for a floor vote today in the Senate passed (in the Senate) today! As we mentioned previously, the bill passed in the Assembly on 5/21. Next step is to push hard for the Governor to sign the bill into law. So (to be clear) this is not a done deal – yet.
Just to clarify this bill pertains to LMHCs, LMFTs and LPs currently working in certain settings, as defined by SED in regulations, provided that such settings shall not include a private practice owned or operated by the applicant, to continue to diagnose through June 24, 2027. At such time, individuals will need to obtain a privilege from SED in order to diagnose.

LEGISLATION: S7622 – (Brouk) / A 8045 (Bronson)Extends certain provisions authorizing certain mental health practitioners to engage in diagnosis and the development of assessment-based treatment plans STATUS: The bill is on the Senate active list to pass tomorrow. The ‘same as’ Assembly version of the bill (A8045) passed on May 21. WHAT IT DOES: The bill would give certain practitioners more time (until June 2027 rather than until June 24, 2025 as current regulation includes) to obtain the SED Diagnostic Privilege. In the interim the practitioner would be permitted to continue to diagnose and complete assessment-based treatment plans under appropriate supervision and according to regulations.
NOTE: Scheduled for Senate floor vote tomorrow. If it passes, it will move to the governor’s desk for final action. Stand by for more.
