New Restrictions on Providing Federal Public Benefits to Noncitizens
Date & Time
Jul 18, 2025 10:00 AM
Description
The Department of Health and Human Services issued a notice reinterpreting the term “Federal public benefit” used in Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA). The new definition will prohibit programs funded under the Certified Community Behavioral Health Clinics Program, Community Mental Health Services Block Grant, Substance Use Prevention, Treatment, and Recovery Services Block Grant, including grant programs administered by SAMHSA, to be provided to individuals who are not U.S. citizens or “qualified aliens.” At the same time, PRWORA exempts nonprofit charitable organizations from any requirement to determine, verify, or otherwise require proof of eligibility of any applicant for benefits. Join this webinar for a discussion of who is now eligible for services, collection of data, and the provision of services under your federal funding, as well as what subsequent federal issuances we may expect.

IRS Urges Federal Court to Approve Settlement Agreement Undermining Nonprofit Nonpartisanship Last week, the Internal Revenue Service (IRS) and the National Religious Broadcasters, along with two churches in Texas, urged a federal court judge to approve a legal settlement between the parties in a landmark case on nonprofit nonpartisanship. The Johnson Amendment, a federal law approved by Congress with strong bipartisan support more than 70 years ago, prohibits charitable nonprofits, including houses of worship, from endorsing or opposing candidates for public office. The Johnson Amendment undergirds a bedrock principle that nonprofits must remain nonpartisan in law, fact, and purpose. The settlement agreement proposed by the IRS and NRB would declare the Johnson Amendment unconstitutional. The agreement would also bar enforcement of the Johnson Amendment against the two churches involved in the case.[Read more] |

ACTION ALERT: Nonprofit organizations – including faith-based organizations – can help protect nonprofit nonpartisanship by signing onto a national letter, led by the National Council of Nonprofits, Independent Sector, Interfaith Alliance, Americans United for Separation of Church and State, Public Citizen, American Humanist Association, and Freedom From Religion Foundation. NCN encourages nonprofit organizations and their champions to sign the letter and share widely by the deadline on Monday, July 21 at 9pm Eastern. |
