White House Promulgates Final Rule on MH Parity

We are reviewing the Final Rule and (to a certain extent) we will rely on analysis from experts including the Legal Action Center, the National Council and spotlight the changes that (hopefully) substantially increase access to care for all Americans who need services and hold insurers responsible for a higher level of compliance with MHPEA to include  Network Adequacy and other requirements. 

Here in New York, a proposed update to Network Adequacy, wait times and other standards is in the works and expected to be finalized early next year.

The White House on Monday revealed its final rule on mental health parity. Biden-Harris administration officials are heralding the rule as a “historic” step toward expanding access to mental health services. “There is no reason that breaking your arm should be treated differently than having a mental health condition,” President Joe Biden said in a statement.
The rules apply to group health plans with new plan years starting after Jan. 1, 2025, with other, more technical aspects of the rule going into effect a year later. The new final rule applies to individual health plans starting on Jan. 1, 2026.
